Workers' Compensation

What is it?

Workers' compensation is a state-mandated insurance program that ensures that employees receive prompt, effective medical treatment for on-the-job injuries regardless of who was at fault. In return, these employees are prevented from suing their employers over their injuries.

Who is it for?

Injured workers are entitled to receive workers' compensation benefits – anyone who has been hurt at work from an accident, injury or occupational disease.

How do I determine if I qualify?

If you get hurt or sick because of work, you are eligible for workers' compensation and your employer is required by law to pay for workers' compensation benefits. Workers' compensation benefits and conditions vary by state.  

In California:

Vocational Rehabilitation is a benefit that covers the costs of career training, guidance and job assistance.  If you were injured on or after January 1, 2004, this benefit consists of a voucher that you redeem at the school of your choice for the purpose of retraining.  To qualify, your doctor must determine that you are a Qualified Injured Worker (QIW), which means you are permanently unable to work in the position you had when you were injured.
